WHAT YOU SHOULD KNOW ABOUT THIS TYPE OF RENTAL AGREEMENT

Our Urban Leasing Law differentiates between “habitual residence lease” and “lease for different type of use than habitual or temporary use”.

Long-term rental contracts are within the first group and have specific characteristics in terms of duration and guarantees.

Duration

Long-term rental contracts have a duration of one year, extendable up to five or seven, depending on whether it is a lease between individuals or if the landlord is a company.

Although it is possible to agree on a shorter duration, housing rental contracts are automatically extended for annual periods until the time established by law is completed.

Additional guarantees

The deposit established by law in long-term rentals is one monthly payment.

The law also establishes that the owner has the right to request an additional security deposit to ensure the fulfillment of the tenant’s obligations. The modification of the Urban Leasing Law made in 2019 dictates that the maximum monthly payments that can be requested as additional guarantee are 2.
