1. INTRODUCTION

This website, including all services that may be offered on it (the “Website”), is operated by Calderona Real Estate, S.L. (“Monserrate Premium Home Agents”). This privacy policy describes the processing of the personal data that the user may provide, or allow access to, through the Website (the “Personal Data”). Should the services offered through the Website have their own privacy terms, those terms shall prevail over this policy in the event of any contradiction.

3. PURPOSES OF PROCESSING AND LEGAL BASES

Monserrate Premium Home Agents will only collect the Personal Data that users voluntarily provide (i) through the forms made available by Monserrate Premium Home Agents (for example, contact forms, property registration forms, etc.); and (ii) through the contact addresses that Monserrate Premium Home Agents may make available to users from time to time.

Monserrate Premium Home Agents may process Personal Data for the following purposes (the “Purposes”) and on the following legal bases:

To manage acceptance of, and monitor compliance with, the General Terms of Use of the Website (or the terms and conditions that may, where applicable, govern other services that Monserrate Premium Home Agents might offer on the Website).	This Purpose is based on the existence of a contractual relationship arising from the user’s acceptance of the aforementioned terms and conditions and from the express request for the services of Monserrate Premium Home Agents. Processing of the Personal Data is therefore necessary for the performance of that contractual relationship.

To comply with its legal obligations and defend its interests in any judicial or administrative proceedings brought in any jurisdiction.	This Purpose is based on the existence of legal obligations applicable to Monserrate Premium Home Agents.
To carry out any reorganisation, merger, sale, joint venture, assignment or transfer of all or part of its business or assets (which would include, for example, the sale of the Website’s databases).	This Purpose is based on the existence of a legitimate business interest of Monserrate Premium Home Agents consisting of the continuity of the provision of its services and the successful completion of any commercial transaction that may be carried out.
Unless the user objects, to send users communications by any means, including electronic means, concerning information about the real estate sector and about properties matching the characteristics indicated by the user.	This Purpose is based on the existence of a legitimate business interest of Monserrate Premium Home Agents consisting of building user loyalty, promoting the image of Monserrate Premium Home Agents and, ultimately, providing users with real estate information of interest to them.

4. DISCLOSURE OF PERSONAL DATA TO THIRD PARTIES

Users’ Personal Data may be disclosed to third parties who (i) necessarily need to know it in order for Monserrate Premium Home Agents to comply with its legal obligations (for example, responding to requests from judicial, administrative or governmental bodies or any other competent institutions); and/or (ii) work in the name and on behalf of Monserrate Premium Home Agents, collaborating with Monserrate Premium Home Agents in carrying out any of the Purposes (for example, providing technical support or Website hosting services).

5. DATA RETENTION

Users’ Personal Data will be retained for as long as the contractual relationship remains in force. Once it has ended, the data will be retained for a period of six years, in accordance with the legal obligations set out in the Spanish Commercial Code, unless longer periods apply that make it necessary to retain the data for a longer time in order to address any type of legal or contractual liability. In any event, as regards the use of data for the purpose of sending information relating to the real estate sector, Monserrate Premium Home Agents may continue to send the information indicated unless the user objects as set out in section 7.

The Website uses “cookies” (files downloaded to the user’s computer, smartphone or tablet when accessing certain web pages, in order to store and retrieve information about the browsing carried out from that device). The user has the right to lodge complaints with the Spanish Data Protection Agency (Agencia Española de Protección de Datos), the competent national authority in this area.
